These terms explain what PowerSalesRecruiting.com delivers, what the employer controls, and how package fees and ad spend are handled.

1) Agreement Overview

By purchasing, accessing, or using services from PowerSalesRecruiting.com (“PowerSalesRecruiting,” “we,” “our,” or “us”), you (“Client,” “Employer,” or “you”) agree to these Terms of Service (“Terms”).

If you do not agree, do not purchase or use our services.

2) What We Deliver Service Scope

PowerSalesRecruiting.com provides pay-for-results recruiting support designed to help employers source and evaluate candidates. Depending on the package purchased, we may deliver:

  • Screened applicants (candidate submissions that meet baseline criteria), and/or
  • A vetted slate of 3–5 candidates that may include screening notes, summaries, rankings, and recommended next steps.
Important: We do not guarantee that any candidate will accept an offer, remain available, pass background checks, or perform successfully if hired. Our obligation is limited to delivering recruiting support and candidate information as outlined in the purchased package.

3) What You Control Employer Responsibilities

The Client retains full control and responsibility for all hiring and employment decisions, including:

  • Interviewing and selecting candidates
  • Hiring decisions and offer terms
  • Compensation, commission plans, benefits, and incentives
  • Onboarding, training, supervision, and termination
  • Employment classification (employee vs. contractor) and compliance with applicable laws

PowerSalesRecruiting.com is not an employer, co-employer, staffing agency, or employment agency.

4) How You Pay Fees & Ad Spend

Our services are sold using flat package fees (e.g., per-slate or per-applicant packages) as listed on the website or agreed in writing.

  • Ad spend is paid by the employer (Indeed, LinkedIn, Google, job boards, etc.) unless explicitly included in writing.
  • We do not charge salary-percentage placement fees.
  • We do not charge “headhunter” success fees tied to compensation.

Fees are generally non-refundable once services begin, unless a written exception applies.

5) No Guarantee of Hire Results

While we aim to deliver strong candidates, recruiting outcomes depend on many factors outside our control, including candidate availability, market competition, compensation alignment, interview speed, and internal decision-making.

The Client is responsible for conducting any desired background checks, reference checks, assessments, and verification of credentials.

6) Confidentiality Candidate & Client Data

Candidate information provided to the Client is shared solely for recruiting evaluation and hiring purposes. You agree to keep candidate data reasonably confidential and to comply with applicable privacy and employment laws.

7) Limitation of Liability Legal

To the maximum extent permitted by law, PowerSalesRecruiting.com is not liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our services.

Our total liability for any claim related to services shall not exceed the amount paid by the Client for the specific package giving rise to the claim.

8) Governing Law State

These Terms are governed by the laws of the State of [Insert State, e.g., Georgia], without regard to conflict-of-law rules.
